This Privacy Policy ("Policy") informs you of the types of information INFIMA Security, Inc. (“INFIMA,” “we,” “us,” “our,” or the “Company”) collects about you when you visit our website at http://www.infimasec.com and associated sub-domains (“Site”); download and install any of our products, or any installer or other applications we provide to you (collectively, “Product”); and how we use that information. By visiting the Site, downloading the Product, or utilizing the Site or Product, you agree to the provisions of this Policy. Unless stated otherwise, our current Policy applies to all information that we collect from or about you.
This Policy does not apply to information collected by any third party, including through any application or content that may link to or be accessible from the Site or Product. If you do not agree to the terms of this Policy, please do not use, access, download, install, or utilize (collectively, “use”) any INFIMA Products or otherwise provide us with any personal information.
By using or accessing our Site or Products in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby agree that we will collect, use, process, and share your information as described in this Policy. This Policy is written in the English language. We do not guarantee the accuracy of any translated versions of this Policy. To the extent that any translated versions of this Policy conflict with the English language version, the English language version of this Policy shall control.
Information We Collect and How We Use Your Information Information You Provide to Us
INFIMA will collect personal information from you directly when you send us an email or otherwise contact us, create an account or use our interactive tools, interact with our Site or Products, voluntarily provide information in free-form text boxes through the Service or through responses to surveys or questionnaires, subscribe, share materials, sign up to receive offers or emails from us, or order or purchase our products. INFIMA will also collect information, including personal information, in connection with any emails or messages you identify as phishing or security exploits via the Product, including personal information about you as a submitter and as may be contained within the submitted emails or messages.
Information We Collect and How We Use Your Information When You Use INFIMA Products
We may automatically collect certain aggregate information and analytical data related to your use of the Site or Products, including visiting the Site (see “Tracking Technologies” below). Aggregate information is non-personally identifiable or anonymous information about you, including the date and time of your visit; the Internet Protocol (“IP”) address of your computer; information about your browser and operating system; the state or country from which you accessed the Site; the Internet address you visited before reaching the Site; error logs; the name of the domain and host you used to access the Internet; the features of the Site that you accessed; and other hardware and software information. However, none of the automatically collected aggregate information and analytical data described above is associated with your personally identifiable information unless you voluntarily share your personal information with us.
We use log files to manage traffic loads and information technology requirements for providing reliable service, as well as to enhance the Site by tailoring our content to your interests and needs.
We may also use Google Analytics and other third-party analytics providers to assist in collecting aggregate information to improve our Site. Google’s use and collection of information from our Site are governed by the Google Analytics Terms of Use and the Google Privacy Policy. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-Out Browser Add-on by clicking here.
If you download and install certain applications and software we make available, we may also receive and collect information transmitted from your computing device for the purpose of providing the Product to you, such as information regarding when you are logged on and available to receive updates or alert notices. The purposes of this collection include:
- Creating and managing your account or other user profiles.
- Payment processing, billing, and processing orders or other transactions.
- Providing you with the products, services, and information you request.
- Meeting or fulfilling the reason you provided the information to us.
- Providing support and assistance for the Site and Product.
- Quality management services, Site and Product maintenance, and improving the Service, including testing, research, internal analytics, and product development.
- Personalizing the Site and Product, website content, and communications based on your preferences.
- Doing fraud protection, security, and debugging.
- User verification.
- Responding to correspondence that we receive from you, contacting you when necessary or requested, and sending you information about the Site and Product.
- Sending emails and other communications according to your preferences or that display content that we think will interest you.
- Fulfilling our legal obligations under applicable law, regulation, court order or other legal process, such as preventing, detecting, and investigating security incidents and potentially illegal or prohibited activities.
- Protecting the rights, property or safety of you, INFIMA, or another party.
- Enforcing any agreements with you.
- Responding to claims that any posting or other content violates third-party rights.
- Resolving disputes.
When you integrate the Product with an email account or inbox, you acknowledge that the Product may automatically inspect, review, read, process, or otherwise examine the contents of emails or messages in that inbox or account, as well as track metadata and related behavioral patterns you or other users engage in within such mailbox or account. This process is limited solely to (i) identifying emails constituting phishing or other methods of security exploitation, and (ii) collecting information regarding your email practices for the development of simulated phishing or security exploitation methods to be implemented via the Product. Personal data obtained from this process will not be shared with any other party. Any part of such data or message contents will have sensitive and personal data removed prior to any use or disclosure by INFIMA.
Email Communications
On our Site, you can sign up to receive additional information, attend a webinar or sign up to attend a live event. To receive additional information from us, you must provide your name, company name, email address, and phone number. Our third-party business partners provide INFIMA with services that may require us to provide them with your personal information. These third-party business partners are not permitted to use the information collected on our behalf except to help us conduct business, improve, or provide the Site or Products.
We may also send you notifications via email regarding INFIMA Products for the purpose of keeping you informed of any updates or changes to the INFIMA Products, e.g., product updates and support communications. These email communications are essential for the continued functionality of the INFIMA Products, and you will continue to receive these types of email communications even if you choose to opt-out of any other email communication from us.
If you would like to review your communication preferences, or if you do not want to receive further information or materials from us, you can update your information or opt-out by following the instructions contained within each communication from us. Your Account Information
Information you provide when you create an account on our Site, register your Product or in relation to the receipt of any other services from INFIMA may include your name, company name, personal or business email address or both, phone number, and other personally identifiable information (“Account Information”). Your Account Information is stored securely with controlled access and used to inform you of upcoming events, send you information and updates, respond to inquiries for service requests, authenticate your use of the Site or Product, manage the Site and the Product, and assess the usage of the Site and Product.
In connection with providing Products to its clients, INFIMA may collect personally identifiable information from employees and customers of our clients, users of our clients' networks and systems, and individuals that connect to our clients' networks and systems. The use of information collected as a result of providing INFIMA Products to our clients will be limited to the purposes for providing the Product to the client. We may transfer personal information to other companies that help us provide our Software and Services to our clients. Transfers to subsequent third parties are covered by the service agreements with our clients.
Information From Third Parties
We may receive personal information about you from our third-party affiliates or partners and from marketing companies that provide us with such information as a part of their relationship with us.
We may use analytics providers to analyze how you interact and engage with the Site or Product, or third parties may help us provide you with customer support. We may also use vendors to obtain information to generate leads and create user profiles.
We receive information about you from some of our vendors who assist us with marketing or promotional services related to how you interact with our websites, applications, products, advertisements, or communications.
Tracking Technologies
INFIMA and its partners use cookies or similar technologies to analyze trends, administer the Site, track users’ movements around the Site, and gather demographic information about our user base as a whole. The technologies we use for automatic data collection may include, e.g., browser cookies, web beacons and flash cookies.
You may manage how your mobile device and browser handles cookies by adjusting its privacy and security settings. Mobile devices and browsers are different, so refer to instructions related to your device and browser to learn about cookie-related and other privacy and security settings that may be available. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our website or service. We recognize do-not-track and opt-out preference signals, such as the Global Privacy Control, on browsers, browser extensions, or devices that support such a signal. Such signals will be automatically linked to your browser or device identifier, and we will process them as a valid, automatic request to opt-out of the sale and sharing of your personal information in the event personal information is ever shared or sold.
Third-Party Use of Cookies and Other Tracking Technologies
Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third-parties may use cookies (alone or in conjunction with web beacons or other tracking technologies) to collect information about you when you use our Site.
Our Use of Your Information
In addition to the uses described elsewhere in this Policy, we may use your information to send you automated messages via e-mail, text message, or other means (collectively, “Messages”) to any contact method(s) provided by you or your employer to INFIMA. You confirm that you want INFIMA to send you these Messages and agree to receive them. You further acknowledge and agree that the Messages may contain simulated attempts at phishing or other security exploits. As a result, Messages may contain deceptive, untruthful, or manipulative devices, statements, or wording, may be written to invoke fear, uncertainty, doubt, or other negative emotional or irrational responses, and may purport to be sent from parties other than INFIMA.
You agree that INFIMA may use any information it collects or possesses related to you in the preparation, drafting, sending, and analysis of these Messages. You further agree that INFIMA may collect additional information, including personal information, based on your interaction with Messages sent by INFIMA.
Unless otherwise expressly stated by INFIMA, or required by controlling law, INFIMA will have no obligation to preserve any specific data related to Your use of the Product or Site, including data collected about you or submitted by you to the Product or Site. INFIMA reserves the right to delete or destroy such information at any time in its sole discretion.
Outside Parties; Disclosure of Information
Except as provided in this Policy, we do not sell, trade, lease, rent, or otherwise transfer your personal information to third-parties. We may share your information with third-party business partners and service providers who assist us in operating our Site or Product, conducting our business, and providing you with the Products. We may also share personal information with third parties when we have your consent to do so. INFIMA requires these third-parties to take commercially reasonable steps to safeguard your personal information and not use your personal information for other purposes unless you consent.
We may also disclose your personal information as required by law, such as to comply with a subpoena or other legal process, when we believe in good faith that such disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, respond to a government request, or to conduct investigations of violations of our End User License Agreement. For example, if we conduct a fraud investigation and conclude that one side has engaged in deceptive practices, we may provide that person or entity's contact information to victims who request it.
We may also provide access to, assign, or disclose information maintained by us, including your Account Information, in connection with a corporate transaction, such as a merger, acquisition, or purchase of all or substantially all of our assets.
Third Party Links
The Site includes links to third-party sites, products, or services, and your access to these third-party sites, products, or services may result in the collection or sharing of your information. These third parties have separate and independent privacy policies. We are not responsible or liable for the content and activities of these linked sites, products, or services. The inclusion of these third-party sites, products, or services on our Site shall not be construed to be an endorsement or representation regarding any third-party sites, products, or services. We encourage you to review the privacy policies of such third parties.
Security
The security of your personal information is important to us. If you choose to provide us with your personal information, you understand that we are transferring it to INFIMA's locations and systems in the United States or to the locations and systems of INFIMA's service providers around the world. INFIMA uses reasonable security measures to protect the loss, misuse, and alteration of the information under its control. Such measures may change from time to time, depending on industry standards and perceived security risks. However, despite such security measures, INFIMA cannot guarantee the security of your information and disclaims liability for loss, misuse, and alteration of your information under its control to the maximum extent permitted under applicable law. By using the Site or Product, you agree to assume any security risk related to personal information. International Users
INFIMA is a U.S.-based business and may process, transfer, and store information about users of the Site or Product on servers located in a number of countries, including the United States. As a result, your personal information may be subject to data protection and other laws that may differ from your country of residence. Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the countries in which we operate. By using the Site or Product, or by providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside or are a citizen.
Children and Individuals Under 18
The Service is not meant for individuals under the age of eighteen, and the Service may use mechanisms to prevent the registration and use of the Service by such underage individuals. INFIMA will never knowingly request or collect personal information from any child. If you are under eighteen years old, please do not provide your information on our Service. Upon notification that a child has provided us with personally identifiable information, we will delete the child's personally identifiable information from our records. Additional Terms and Conditions for Software
Please also visit our Terms of Service section establishing the use, disclaimers, and limitations of liability governing the use of the Product at Terms of Service and the Site at Terms of Service. This Policy applies only to information collected through our Site or by the use of our Product and not to information collected offline. Your download or use of our Product is subject to additional terms and conditions that define your rights, as well as our rights, with respect to the Product and its use. Those additional terms and conditions are contained in the End User License Agreement that you are required to accept prior to downloading or using the Software and the terms linked above.

Effective Date; Changes to Our Privacy Policy
Each time you use the Site or Products, the current version of this Policy will apply. We reserve the right to change this Policy at any time to reflect changes in the law, the Site or Products we provide, our business and technology, and our data collection and use practices. If you choose to submit a Consumer Request, you must provide us with enough information to identify you (e.g., your first and last name, email address, and telephone number) and enough specificity on the requested data. We will only use the information we receive to respond to your request. We will not be able to disclose information if we cannot verify that the person making the Consumer Request is the person about whom we collected information, or someone authorized to act on such person's behalf. We will verify your request by comparing the information you provide with the information we have on you and, if your request is submitted by an authorized agent, we will require you to provide signed, written permission for such agent to act on your behalf.

- Request to Delete. You may request that we delete personal information we have collected from you. Please note that we may not delete your personal information if it is necessary to:
- Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by the consumer, or reasonably anticipated by the consumer within the context of a business' ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer.

- Debug to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise that consumer's right of free speech, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
- Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the business' deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if the consumer has provided informed consent.
- To enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer's relationship with the business and compatible with the context in which the consumer provided the information.
- Comply with a legal obligation.
- Right to Access Information About Automatic Decision-Making. We do not currently engage in automated individual decision-making. However, in the event we ever do so, we will inform you of such change and you may request information about and opt out of such automated decision-making.
- Right to Data Portability. You may also request that we transfer your personal information to another entity, to the extent such transfer is technically feasible.
We may not, and will not, treat you differently because of your Consumer Request activity. As a result of your Consumer Request activity, we may not and will not deny goods or services to you; charge different rates for goods or services; provide a different level quality of goods or services; or suggest any of the preceding will occur. However, we can and may charge you a different rate, or provide a different level of quality, if the difference is reasonably related to the value provided by your personal information.
Special Notice for Nevada Residents
